Terms of Use of the Romanian GDI Node Portal

1. Introduction

This portal (hereinafter 'Portal'), available at https://gdi.genomica.gov.ro, is the Romanian national node of the Genomic Data Infrastructure (GDI). It is operated by the Institutul de Cercetare-Dezvoltare în Genomică (ICDG), Str. Dionisie Lupu nr. 37, Sector 1, București, România (hereinafter 'ICDG'). ICDG can be contacted at contact@genomica.gov.ro.

2. Purpose

The Portal lets researchers discover datasets published by ICDG, query aggregated genomic information, and apply for access to datasets according to the data access process of each dataset. Datasets currently published through the Portal are open or synthetic data; no data about identifiable individuals is made available through it.

3. Use of the Portal

3.1. Public features

Anybody can use the public features of the Portal (dataset search, dataset pages, aggregated queries), in accordance with these Terms.

3.2. Signed-in features

Applying for access to a dataset requires signing in, with Life Science Login or with an ICDG account. Users must:

• give accurate information about their identity, affiliation and intended use of the data;
• keep their sign-in credentials to themselves;
• use any data obtained only for the purpose and under the conditions approved for that dataset;
• acknowledge the data source in any results obtained with data from the Portal;
• report any known or suspected security incident or misuse without delay (section 8).

3.3. Prohibited activities

Users must not:

• disrupt or attempt to disrupt the Portal or the services behind it;
• try to re-identify any person from the data;
• misrepresent their identity or affiliation;
• use the Portal for commercial purposes, unless the data access conditions of a dataset allow it.

4. Liability

The Portal and its data are provided 'as is'. ICDG does not guarantee that the Portal is uninterrupted or free of errors, and may change, correct or remove its content at any time. Users are responsible for how they use the Portal and its data.

5. Suspension and termination

ICDG may suspend access to the Portal for maintenance, updates or security reasons. ICDG may suspend or close a User's access when the User breaches these Terms or when a security incident is attributable to the User. Users may stop using the Portal at any time and may ask for their account to be closed (section 7).

6. Governing law and changes

These Terms are governed by Romanian law. ICDG may update these Terms; the current version is always published on this page.

Privacy Notice

What we process and why

ICDG does not use the data for marketing, does not sell it, and does not use analytics or tracking cookies on this Portal.

Who receives the data

• The people who review data access applications for a dataset (its data access committee) see the applications made for that dataset.
• Life Science Login (the Life Science AAI, operated for ELIXIR and the European life science research infrastructures) authenticates you when you choose it, under its own privacy notice.
• Technical service providers who host and operate the Portal infrastructure for ICDG, under contract and only to provide the service.

Transfers outside the EU/EEA

ICDG does not transfer personal data processed through this Portal outside the EU/EEA.

How long we keep the data

• Server logs: a short period, for security and troubleshooting.
• Account data: while your account exists. You can ask for it to be deleted at any time.
• Data access applications and decisions: as long as the access they grant is in force, and afterwards as long as needed to document who accessed which data, in line with Romanian archiving law.

Your rights

You have the right to information, access, rectification, erasure, restriction of processing, data portability and objection, and the right to withdraw consent where processing is based on consent. To exercise them, contact the data protection officer above.

You also have the right to lodge a complaint with the Romanian data protection authority, the Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal (www.dataprotection.ro).

Cookie Policy

The Portal uses only cookies that are needed for it to work. It uses no analytics, advertising or tracking cookies.

You can delete or block cookies in your browser settings. Blocking them prevents signing in.

Security Incident Response

ICDG operates this Portal and the identity service behind it (auth.genomica.gov.ro). To report a known or suspected security incident, misuse of data or compromised credentials, write to contact@genomica.gov.ro and to the data protection officer (adrian.buzatu@genomica.gov.ro).

When an incident affects the Portal or its users, ICDG:

• confirms receipt of the report and investigates it;
• contains the incident, for example by suspending affected accounts or services;
• informs the affected users and, where a federated identity is involved, the Life Science AAI operators, and cooperates with them in the investigation;
• notifies the Romanian data protection authority and the persons concerned when the GDPR requires it.
